Welcome to Eyecerity. These Terms of Service ("Terms") govern your access to and use of the Eyecerity website, application, and related services (collectively, the "Service") operated by Eyecerity ("we," "us," or "our"). Please read these Terms carefully before using the Service.
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Eyecerity is an AI-powered mock interview coaching platform. The Service enables you to practice answering interview questions in a simulated environment and receive AI-generated feedback on your performance. Key components include:
To use certain features of the Service, you must create an account. You agree to provide accurate and complete registration information, keep your login credentials confidential, promptly notify us of any unauthorized access to your account, and accept responsibility for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

Eyecerity offers free and paid subscription plans. By selecting a paid plan, you authorize us to charge your payment method on each billing cycle (monthly or annually) through our payment processor, Stripe, Inc. Eyecerity never receives, processes, or stores your full credit card number.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You retain access to paid features until the end of the period you have already paid for. No partial refunds are issued for unused time.
Because Eyecerity provides access to a digital service with immediate availability upon payment, refunds are generally not provided. If you believe you were charged in error, contact us at [email protected] within 14 days of the charge.
We reserve the right to change subscription pricing with at least 30 days' written notice (via email or through the Service). Continued use after a price change constitutes acceptance of the new pricing.
The Service and its entire contents, features, and functionality — including all information, software, text, displays, images, audio, and design — are owned by Eyecerity, its licensors, or other providers and are protected by United States and international copyright, trademark, and other intellectual property laws.
You are granted a revocable, non-exclusive, non-transferable, limited license to access and use the Service for your personal, non-commercial use strictly in accordance with these Terms. This license does not include the right to copy, modify, reproduce, or distribute any part of the Service without our express prior written permission.
Your interview transcripts, speech delivery metrics, AI-generated scorecards, and any other data generated through your use of the interview features remain your property. Eyecerity claims no ownership over your interview data. We retain only a limited, non-exclusive license to process, store, and transmit this data solely for the purpose of providing and improving the Service. This license terminates when you delete your account.
If you voluntarily submit product feedback, feature suggestions, or improvement proposals ("Feedback"), you agree that such Feedback becomes the property of Eyecerity and may be used for any purpose without compensation to you. "Feedback" does not include your interview content or session data.
AI-generated feedback, scores, grades, and recommendations provided by Eyecerity are for educational and practice purposes only. They do not constitute professional career advice, employment counseling, or any guarantee of interview success or employment. You should not rely solely on Eyecerity's output when making career decisions.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, EYECERITY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Without limiting the foregoing, Eyecerity makes no warranty that the Service will meet your requirements, operate without interruption, be error-free, or that any errors will be corrected. Eyecerity does not warrant the accuracy, reliability, or completeness of any AI-generated content.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EYECERITY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF EYECERITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
EYECERITY'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO EYECERITY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some or all of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Eyecerity and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, at our sole discretion. You may terminate your account at any time by deleting it through your account settings or by contacting us at [email protected].
Upon termination, your right to use the Service ceases immediately. If you delete your account, your personal data, interview transcripts, and scorecards will be permanently removed in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — shall survive.
In the event of a dispute arising from or related to these Terms or the Service, you agree to first attempt resolution through informal negotiation by sending a written notice to [email protected]. If the dispute is not resolved within sixty (60) days, either party may pursue binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. This provision does not prevent either party from seeking injunctive or equitable relief in a court of competent jurisdiction for intellectual property disputes.
YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
These Terms are governed by and construed in accordance with the laws of the United States and the State of New Jersey, without regard to conflict of law principles.
We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days' notice before the new terms take effect. We will notify you of changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you may delete your account.
If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eyecerity regarding your use of the Service and supersede all prior and contemporaneous agreements, understandings, and communications, whether written or oral.
